should a mortgage be issued if there is Dept incurred by the electical contractor by not paying the electrical supplier in the state of florida

I have a 20 day summons lodged against me and my wife for none payment of supplies incurred by the Electrical contractor on five of the houses build by the main contractor.
We have a Lien against our house and that has been there for some time, as we were told by the Electrical contractor that they were taking care of it!!!!and is still there.
